8:36 Bullock moved to postpone the Interlocal Agreement Red Lodge Tax Increment District Software; Miller seconded; motion carried.
8:45 Bullock Departed.
9:30 Commissioner Scott Blain joined the meeting. Lori Lynde was in attendance for Treasurer Collateral report. Lynde review the report with and ending cash balance of $28,884,311.25. Blain moved to approve the June 2023 Collateral Report; Miller seconded; motion carried.
Lynde noted in the process of changing the credit card company her office uses. Lynde believes it will provide convenience for her staff and ultimately save the County money; the company collects the convenience fee directly and will provide additional processing machines so the office has more accessibility. Blain moved to approve Credit Card Agreement with Certified Payments by Delux; Miller seconded; motion carried.
Blain moved to approve Justice Court End of Period Disbursement for June 2023; Miller seconded; motion carried.
Blain moved to approve Claims for the second June check run; Miller seconded; motion carried.
10:00 Contract Civil Deputy Attorney Jacque Papez discussed the encroachment onto County property from Tabacas, LLC’s new wine bar. Issues include roof drainage onto County property, tree replacement, and termination of the sprinkler head. 10:30 Todd Buchanan joined the meeting. Papez noted processes to allow the encroachment include a property sale, easement, or lease. Requirements for a property sale under Montana Code make this option challenging for the County, Papez favors an easement. Discussion if access around the County’s building could be gained without affecting drainage from their building. Discussion about what the County would like to see for tree replacements; similar conifer trees are preferred. Discussed easement terms; it would be a perpetual easement with termination and attorney fee clauses so the County has an option to address further encroachments or drainage issues.
