Commissioners Scott Miller, Scott Blain, and Bill Bullock; and Administrative Officer Angela Newell were present.
8:30 Pledge of Allegiance.
Public Comment Mike Keys and James McGregor met with Commissioners regarding petitions that are being circulated to place legalization back on the ballot. Keys and McGregor noted reports that those circulating the petitions are representing that marijuana shops will be selling sexually explicit material. Keys noted he confronted one of the petitioners regarding the issue and she was adamant that dispensaries would have sexually explicit material and a pungent aroma. Both Keys and McGregor also expressed their opposition to the requested variance regarding distance to other marijuana use businesses for the Purple Cow Dispensary in Rockvale.
10:30 Disaster and Emergency Services (DES) Coordinator Cyrina Allen and Geospatial Information Systems Coordinator / Fire Warden Tom Kohley met with Commissioners for their monthly update. Report attached.
Miller moved to approve employee time; Blain seconded; motion carried.
11:00 Contract Planner Forrest Mandeville, Kate Stout Red Lodge Surveying, Deputy Clerk and Recorder Macque Bohleen met with Commissioners for the final plat of the Grewell Subdivision. Mandeville reviewed staff report (attached). All preliminary conditions having been met. Blain having reviewed and considered the application materials, project memorandum, and all of the information presented, moved to approve of the Grewell Subdivision final plat; Miller seconded; motion carried.
11:30 Contract Planner Forrest Mandeville, Deputy Clerk and Recorder Macque, and Carbon County News Reporter Denise Rivette met regarding a Group 2 Development Permit Variance Request from the Purple Cow Dispensary. Mandeville reviewed the Planning Board recommendation (attached). Blain having reviewed and considered the variance request, staff report, public comment, Board of Adjustment’s recommendation, and all of the information presented, moved to accept the variance request for the Schneider Purple Cow Dispensary Group 2 Development Permit; Miller seconded. Blain noted the variance is in direct opposition to interim zoning regulations setback requirements from other marijuana businesses, Miller noted the purpose of this prevision was reduce clustering of marijuana businesses; all three Commissioners voted in opposition. Motion failed and variance request was denied. Commissioners thanked the Planning Board for their diligence.
