9:00 Commissioners discussed asphalt projects for the Road and Bridge Budget. Farewell Road will be paved in the 2019 construction season and the Red Lodge District will be tearing up and repaving Clear Creek Road.

Commissioners discussed their department budget. The office supply line was increased to purchase a new laptop for Commissioner DeArmond; the tire line was increased for Commissioner Blain and DeArmond’s vehicles; the dues line was increased to pay for increased advertising costs; the travel line was increased to account for all three Commissioners attending the Montana Association of Counties training in December and possibly a trip to Washington D.C., for Montana day at the White House.
Commissioner Bullock moved to approve Commissioner Minutes for May 13 and May 16; Commissioner DeArmond seconded; motion carried.
10:30 Justice of the Peace Kevin Nichols met with Commissioners for his preliminary budget. With a clerk retiring next spring salary budgets were increased to account for overlap to train a new employee. The office will also need to replace their printer/scanner in the upcoming year. Judge Nichols also discussed jail planning and supported the efforts to construct a jail in the County.
11:00 Kyle McKinney, Joseph A. Flowler, Elizabeth Fowler, Kate Stout from Red Lodge Surveying, Johnny Conover, Sanitarian in Training Cortney Lynde, Contract Sanitarian Travis West, and Sanitarian Assistant Lori Kane met with Commissioners regarding sanitary restrictions in the Fowler Subdivision. Ms. McKinney spoke with former sanitarian Greg McGann after Thursday’s meeting; he believed sanitary restrictions were lifted when the subdivision received its final approval. Travis noted the subdivision should have gone through DEQ review in 2005 and the County mistakenly approved the subdivision. Travis noted DEQ is only authority to remove sanitary restrictions; the septic permits previously approved for the other lots were erroneously permitted. Travis noted current planner and DEQ interpret the statute that if parcel is less than 20 acres when the roadway is excluded, the property is subject DEQ approval. The Sanitarian cannot issue a septic permit on Lot 3 because sanitary restrictions have not been lifted. Now that issue is known cannot under law issue permit addressing
comissioners confirmed they will not instruct the Sanitarian to issue a septic permit in violation of State Law and DEQ guidance. It was suggested the issue could be resolved with a boundary line relocation to increase the size of the parcels. Commissioners agreed to assist in pushing through a boundary line relocation as fast as they could, but noted it would still be subject to the exempt certificate of survey process.
