Commissioners Doug Tucker and John Grewell were present.
8:30 Pledge of Allegiance.
John Husar and David McLain met with Commissioners to update them on the Mud Springs Wind Project. They met with U.S. Fish and Wildlife Service Assistant Regional Director for Migratory Birds Clint Riley in Denver last week. At that meeting they discussed data and protocols for collecting data so that additional data can be considered to reevaluate the Class 1 classification. They will also be conducting a spring bat survey although they do not believe there are any protected bat species in the area. Also discussed impact fee; Commissioners would like a breakdown of the projects anticipated return on investment, business plan, and overview of the Federal subsidies the project is receiving so those items can be considered when establishing the impact fee.
9:00 Deputy County Attorney Jacque Papez met with Commissioners to discuss progress on the Pryor Mtn. Road closure issue; another meeting has been scheduled this afternoon with tribe to work toward a solution. They also discussed the Bridger Cemetery land swap. The estimated value of the dryland portion that is proposed for the swap is $1,400/acre; Jacque recommend that a realtor perform a market analysis to determine the market value of the other parcel.
9:30 Dana and Dean Spaulding met with Commissioners regarding the Petition to Abandon the old highway from the Clarks Fork River through Dean Spaulding’s property. Clerk and Recorder Marcia Henigman was also present. No public comment was received. Commissioner Grewell moved to abandon the tract of land Described as “a tract of land situated within the E½SE¼, SE¼NE¼ of Section 10 and the W½SW¼, SW¼NW¼ of Section 11, Township 8 South, Range 22 East, P.M.M., Carbon County, Montana, containing an area of 2.824 ha (6.98 acres), more or less as depicted on the plat attached to the Assignment of Interest in Public Right-of-Way recorded April 27, 2015 at Doc 361189, records of Carbon County, Montana”; Commissioner Tucker seconded; motion carried. Order to abandon will be prepared by the County Attorney and signed at a later date.
10:00 Jean Atherly Public Health Tobacco Prevention Specialist met with Commissioners to discuss implementing tobacco free campus policies for Carbon County. The discussed some sample policies, including e-cigarettes and smokeless tobacco in the policy, and including County vehicles.
Commissioner Tucker moved to accept Treasurer’s Cash report September 2015; Commissioner Grewell seconded; motion carried.
10:40 Clerk and Recorder Marcia Henigman met with Commissioners regarding correspondence from Sheryl Roberts regarding a boundary relocation. The legal description on the remainder piece, which was sold, was not accurate and appears to include Roberts’ property. Marcia noted that it is up to the landowner to correct the legal description as her office cannot alter recorded documents.
11:00 Pam Walling met with Commissioners for MACo Health Care Trust update. Clerk and Recorder Marcia Henigman was also present.
