Commissioners Doug Tucker, John Grewell, and John Prinkki and Administrative Assistant Angela Newell were present.
8:30 Pledge of Allegiance
DES Coord. / GIS Mgr. Tom Kohley met with Commissioners to discuss the landowner placing a gate on Fox Road that would still allow for trail access.
Commissioner Tucker moved to accept Commissioners proceedings for September 8th; Commissioner Grewell seconded; motion carried.
Commissioner Tucker moved to accept District Court Fees Distribution Report for September 2016; Commissioner Grewell seconded; motion carried.
Commissioner Tucker moved to accept Treasurer Cash Report for September 2016; Commissioner Grewell seconded; motion carried.
9:00 Civil Deputy Attorney Jacque Papez met with comm. Discussed Roberts Sewer issues. After digging up a pipe it was discovered that additional utilities including septic, were in the same trench. Jacque is concerned the issue may surpass the County Attorney’s scope of assistance to a water and sewer district under statute. They also discussed an exempt subdivision application that indicated the purpose of the family transfer was to sell the property; this prevents the property from being exempt from subdivision review.
9:10 County Attorney Alex Nixon joined the meeting and it meeting was closed to discuss the Burgen litigation.
9:15 Meeting reopened to the public.
It was noted there has been very little correspondence from landowners regarding the East Rosebud Road since it was graded. Alex mentioned that E. Rosebud association has considered filing documents in District Court requesting a declaratory motion establishing East Rosebud Road as a county road.
9:30 DES Coord. / GIS Mgr. Tom Kohley joined meeting regarding Cottonwood road fire. The fire started as a result of negligent burning in fire restriction period without permit. Alex noted he needs more information to file a complaint for restitution.
10:00 Sheriff Josh McQuillan, County Attorney Alex Nixon, District Court Clerk Rochelle Loyning, Justice of the Peace Kevin Nichols, DES Coord. / GIS Mgr. Tom Kohley, and Architect Susan Hovde met with Commissioners to discuss possible remodel plans for the jail to accommodate Sheriff’s Office space needs. Tom noted dispatch space is only one factor in the buildings space needs; District Court and Justice Court also have space needs that include additional storage. Tom expressed concerns regarding IT logistics if Dispatch was moved to an off-site location. Josh and Tom agree that moving dispatch to the jail would help the flow of Sheriff’s office. Susan believes the proposed projects could be completed in 3 phases: remodel of jail and relocating dispatch, addition of sally port, and addition of the elevator. The remodel of Justice Court Office to include safety glass could be added to any phase. It was noted the City of Red Lodge and Red Lodge Rural Fire both have space needs, and parties discussed if all entities could be better served by a multiuse space. Commissioner Grewell noted the cost of remodeling the current courthouse is comparable to the cost of new construction. Kevin asked if the old hospital on White Avenue had been considered. It had not, Susan will review what issues there have been with proposed remodels of the building in the past. Parties discussed building a capital fund for the eventual relocation of the Court House offices, but thought immediate needs could be addressed with the jail remodel. Commissioner Grewell moved to authorize Susan to prepare bid documents for the jail and Justice Court remodels with the addition of the sally port as an option; Commissioner Tucker seconded; motion carried.
10:50 Commissioner Tucker moved to approve Commissioners Proceedings for September 12th; Commissioner Grewell second; motion carried.
Commissioner Tucker moved to appoint the following to the insurance committee for a term of three (3) years: Jerrid Bergum – Road Department, Pam Schwend – Weed, Jeff Schmalz – Sheriff, Jane Swanson-Webb – Admin. Bldg; Commissioner Grewell seconded; motion carried.
Sheriff Josh McQuillan would like to change the agreement with Beartooth Humane Alliance regarding lost / stray animals to reduce boarding from 7 days to 36hrs. He noted most lost pets are reported within 24 hrs. Commissioners agreed 36hrs is reasonable.
11:00 Tammy Barstad met with Commissioners to discuss fair groundskeeper lease agreement. Commissioner Grewell moved to enter into mobile home space rental agreement with Tammy Barstad based on the template with previous groundskeeper; Commissioner Tucker seconded; motion carried.
Deputy Clerk and Recorder Christine Stovall met with Commissioners regarding indigent burial application. Applicant is on disability. Commissioner Grewell moved to approve application for financial aid indigent cremation for Larry Louis Luksich; Commissioner Tucker seconded; motion carried.
Commissioners signed agreements for Clerk and Recorder e-recording and e-records. Commissioner Grewell moved to accept the Memorandum of Understanding between Carbon County and Corporation Service company for Electronic recording; Commissioner Tucker seconded; motion carried.
